BeeStoon User Agreement

This User Agreement (“Agreement”) is a legal contract between you (“you” or “User”) and BeeStoon (“BeeStoon”, “we”, or “us”), a company based in the United Kingdom. By accessing the BeeStoon website (the “Site”) or downloading/using any BeeStoon plugins or services, you agree to the terms of this Agreement. If you do not agree, do not use the Site or our plugins. This Agreement applies to all users of our Site and plugins who are 13 years of age or older, and it is governed by the laws of England and Wales.

1. Eligibility and Scope of Use

• Age Requirement: You must be at least 13 years old to use BeeStoon’s Site or plugins. If you are under 13, you are not permitted to use our services. If you are 13 or older but under 18 (or the age of majority in your jurisdiction), you should review this Agreement with a parent or guardian.
• Scope – Official Website and Plugins: This Agreement covers your use of the BeeStoon public website and any BeeStoon software plugins for Unreal Engine, Unity, or other platforms downloaded through our official website. Use of BeeStoon’s plugins is authorized only via our official distribution channels.
• Acceptance of Terms: By creating an account, downloading a plugin, or otherwise using our services, you acknowledge that you have read and agree to this Agreement.

2. Privacy and Data Protection (GDPR Compliance)

BeeStoon is committed to protecting your privacy and ensuring compliance with the EU General Data Protection Regulation (GDPR) and other applicable data protection laws.

• Personal Data We Collect: Contact information (name, email), account and profile data, usage data, content and uploads, and transactional data. Payment processing is handled by third-party providers; BeeStoon does not store full credit card details.
• How We Use Personal Data: To provide the service, improve and develop products, train AI models, send communications, and comply with legal obligations.
• AI Model Training and Improvement: BeeStoon will use the content you upload and any feedback you provide to train, refine, and improve our artificial intelligence models. There is no opt-out for this use of your data – by using BeeStoon, you consent to our use of your content for AI training purposes. If you do not want your content used for model training, you should not use BeeStoon’s services.
• Data Storage and Regional Transfers: BeeStoon stores personal data in secure data centers within your region whenever possible. We will not sell your personal data to third parties.
• Retention of Data: We retain personal data as long as necessary to fulfill the purposes described. Content used to train our models may persist in secured archives even after account deletion, as it may be integrated into model weights.
• Your Data Rights: Under GDPR you have the right to access, correct, delete, restrict, or port your personal data. Contact us to exercise these rights; we respond within one month as required by law.

3. User Content, Feedback, and Intellectual Property

• Your Ownership of Your Content: You retain any ownership rights you have in content you submit. BeeStoon does not claim ownership of your pre-existing intellectual property.
• License Grant to BeeStoon: You grant BeeStoon a worldwide, royalty-free, non-exclusive, sublicensable, perpetual, irrevocable license to use your User Content to provide the services and to train and improve our AI models.
• No Compensation for Feedback: Feedback you provide is voluntary. BeeStoon may use it freely without compensation or credit.
• Your Responsibility for Content: You represent that you have all necessary rights to content you upload, and you agree not to upload illegal, infringing, obscene, defamatory, or otherwise prohibited content.
• BeeStoon’s Intellectual Property: Except for your User Content, all IP in the BeeStoon services is owned by BeeStoon or its licensors.
• License to Use BeeStoon Software: BeeStoon grants you a personal, non-exclusive, non-transferable, limited license to use the BeeStoon plugins and Site in accordance with this Agreement.

4. Generated Content: License and Usage Restrictions

• Standard License for Generated Content: BeeStoon grants you a non-exclusive, worldwide, royalty-free license to use Generated Content in your own projects, including commercial games, films, architectural visualizations, and similar works.
• No Standalone Resale or Redistribution (Default Rule): You may not resell, redistribute, or sublicense BeeStoon-generated content as standalone files to third parties (e.g., on asset marketplaces such as the Unreal Engine Marketplace, Unity Asset Store, TurboSquid, etc.) without an Extended License.
• Extended License for Resale/Redistribution: BeeStoon may offer an optional Extended License for users who wish to resell or share generated assets standalone. Unless you have obtained such a license, resale or redistribution of generated content is forbidden.

5. Acceptable Use Policy

When using BeeStoon you agree to:

• Use the service for lawful purposes only.
• Not infringe on the intellectual property rights of others.
• Not transmit malware, viruses, or harmful code, or engage in denial-of-service attacks.
• Not reverse engineer, decompile, or attempt to extract source code from BeeStoon’s software or AI systems.
• Not use bots, scrapers, or automated means to access the website or APIs in an unauthorized manner.
• Respect other users and comply with applicable third-party platform terms (e.g., Unreal Engine, Unity).

6. Disclaimers of Warranties

BeeStoon is provided “as is” and “as available” without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the service will be error-free, uninterrupted, or that AI-generated outputs will be accurate or suited to your particular purposes.

7. Limitation of Liability

To the fullest extent permitted by law, BeeStoon will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total cumulative liability for all claims is limited to the greater of: (a) the total amount you have paid BeeStoon in the last 12 months, or (b) £100 GBP. Nothing in this Agreement limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

8. Termination and Suspension

You may stop using BeeStoon and delete your account at any time. BeeStoon reserves the right to suspend or terminate your access if you breach this Agreement, use the service to cause harm, or as required by law. Upon termination, all licenses granted to you cease immediately. Sections on Generated Content Restrictions, Disclaimers, Limitation of Liability, and Governing Law survive termination.

9. Changes to this Agreement

BeeStoon may update this Agreement from time to time. We will post the updated Agreement on our Site and, for material changes, provide advance notice via email or an in-service alert. Continued use of BeeStoon after updated terms become effective constitutes acceptance. If you do not agree, stop using the service before the new terms take effect.

10. Governing Law and Dispute Resolution

This Agreement is governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising from this Agreement. We encourage you to contact us first to resolve disputes informally before pursuing formal proceedings.

11. Miscellaneous Provisions

This Agreement is the entire agreement between you and BeeStoon concerning the service. If any provision is held invalid, the remaining provisions remain in effect. You may not assign this Agreement without BeeStoon’s prior written consent. Nothing in this Agreement creates any agency, partnership, or joint venture between you and BeeStoon.
